These Terms of Service (“Terms”, “Agreement”) are a legally binding agreement between AutoScanner (“AutoScanner”, “we”, “us”, or “our”) and the person or entity (“User”, “you”) that accesses or uses our website, AI-powered e-commerce tools, product research tools, listing tools, pricing tools, marketplace productivity features, integrations, and related services collectively referred to as the “Service”.
By using AutoScanner, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing our website, connecting a third-party account, purchasing a plan, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
If you use the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility and Account Registration
2.1. Age Requirement
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
2.2. Account Information
You agree to provide accurate, current, and complete account information and to keep your account information updated.
2.3. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must notify us immediately if you suspect unauthorized access to your account.
AutoScanner is not responsible for losses caused by your failure to protect your account credentials.
2.4. Google Authentication
You may create an account or sign in using Google OAuth. By doing so, you authorize AutoScanner to access basic profile information and other authorized data as described in our Privacy Policy.
3. Description of Service
3.1. Platform Purpose
AutoScanner provides AI-powered e-commerce, product research, listing assistance, pricing review, marketplace productivity, and seller workflow tools.
The Service may help users review product information, create listing drafts, analyze marketplace data, monitor product data, manage workflow tasks, and improve operational efficiency.
3.2. AI-Powered Features
AutoScanner may use artificial intelligence to generate suggestions, product analysis, listing drafts, titles, descriptions, pricing insights, keyword ideas, and other e-commerce workflow assistance.
AI-generated outputs may be incomplete, inaccurate, outdated, or unsuitable for a specific use case. You are responsible for reviewing, verifying, editing, and approving all AI-generated content before relying on it or publishing it.
3.3. No Guarantee of Results
AutoScanner does not guarantee any specific business outcome, sales performance, profit margin, ranking, conversion rate, marketplace approval, product availability, or financial result.
Any information provided by the Service is for informational and productivity purposes only and does not constitute financial, legal, tax, or professional advice.
4. Third-Party Integrations and Marketplace Accounts
4.1. Optional Integrations
You may choose to connect third-party accounts or services, including marketplace accounts such as eBay, where supported by the Service.
Integrations are optional and require your authorization through the relevant third-party platform.
4.2. Authorized Use
If you connect a third-party account, AutoScanner may access and process authorized data only to provide the features you request, such as listing support, synchronization, product monitoring, pricing checks, inventory review, analytics, order workflow support, or related seller workflow functions.
AutoScanner will not intentionally perform actions on your connected account beyond the permissions you grant and the features you use.
4.3. User Responsibility
You are solely responsible for ensuring that your use of AutoScanner complies with all applicable laws, regulations, marketplace rules, platform policies, seller agreements, and third-party terms.
You are responsible for reviewing any content, listing, pricing, product data, or workflow action before using it on any third-party platform.
4.4. Third-Party Platform Changes
Third-party platforms may change their APIs, rules, permissions, restrictions, or availability at any time. AutoScanner is not responsible for interruptions, limitations, account restrictions, API changes, or loss of functionality caused by third-party platforms.
4.5. Non-Affiliation
AutoScanner is an independent service provider. AutoScanner is not affiliated with, endorsed by, sponsored by, or officially partnered with eBay Inc., Amazon.com, Inc., Google LLC, or any other third-party marketplace or service unless expressly stated in writing.
All third-party names, logos, and trademarks belong to their respective owners.
5. Subscriptions, Payments, and Billing
5.1. Paid Features
Some features of the Service may require payment, including subscriptions, plans, paid modules, or one-time purchases.
5.2. Billing
Paid features may be billed monthly, annually, usage-based, or as otherwise stated at the time of purchase.
Payments may be processed by authorized payment providers such as Pasha Bank or other approved processors.
We do not store full payment card numbers on our servers.
5.3. Taxes
You are responsible for any applicable taxes, duties, or fees related to your purchase, unless otherwise required by law.
5.4. Automatic Renewal
If a subscription plan includes automatic renewal, your subscription will renew automatically at the end of each billing period unless you cancel it before the renewal date.
You are responsible for canceling your subscription before renewal if you do not wish to continue the paid service.
5.5. Failed Payments
If payment fails, we may suspend or limit access to paid features until payment is successfully completed.
6. Refunds and Cancellations
6.1. Refund Window
Refund requests may be considered within five (5) calendar days of the initial purchase, provided that the paid feature, AI scans, searches, or purchased module have not been substantially used.
6.2. Consumed Services
AI searches, product scans, generated listing content, activated modules, or other consumed digital services may be considered delivered and may not be refundable.
6.3. Subscription Cancellation
You may cancel a subscription according to the cancellation method available in your account settings or by contacting support.
Cancellation stops future renewal but does not automatically refund past payments unless required by law or approved by AutoScanner.
6.4. Billing Disputes
If you believe there is a billing error, you should contact us at support@autoscanner.app so we can review and attempt to resolve the issue.
Nothing in these Terms limits any rights you may have under applicable consumer protection or payment card rules.
7. Acceptable Use
You agree not to use the Service to:
- violate any applicable law, regulation, marketplace policy, or third-party terms;
- access, use, or connect accounts that you do not own or are not authorized to manage;
- submit false, misleading, infringing, illegal, or harmful content;
- attempt to bypass security, authentication, rate limits, usage limits, or access controls;
- reverse engineer, copy, modify, or exploit the Service except as allowed by law;
- use the Service to transmit malware, spam, abusive content, or unauthorized communications;
- overload, disrupt, or interfere with the Service or connected third-party services;
- misuse APIs or connected platform data;
- use the Service for deceptive, fraudulent, or unauthorized marketplace activity.
We may suspend or terminate access if we believe your use violates these Terms, applicable law, or third-party platform requirements.
8. User Content and Data
8.1. User Content
You may submit product data, links, descriptions, images, prompts, marketplace information, account data, or other content to the Service.
You retain ownership of your own content.
8.2. License to Operate the Service
You grant AutoScanner a limited, non-exclusive, worldwide license to process, host, store, display, and use your submitted content only as necessary to provide, secure, maintain, and improve the Service.
8.3. Responsibility for Content
You are responsible for ensuring that you have the necessary rights and permissions to submit, process, or use any content through AutoScanner.
9. Intellectual Property
The Service, software, design, interface, branding, workflows, text, graphics, logos, algorithms, and other materials provided by AutoScanner are owned by AutoScanner or its licensors and are protected by intellectual property laws.
Subject to these Terms, AutoScanner grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal e-commerce workflow purposes.
You may not copy, resell, sublicense, distribute, modify, or create derivative works based on the Service without our prior written permission.
10. AI Output and User Review
AI-generated content is provided as a productivity aid.
You are responsible for reviewing and validating all AI-generated output before using it in listings, product decisions, pricing decisions, marketplace actions, or business operations.
AutoScanner is not responsible for errors, omissions, marketplace policy violations, account restrictions, rejected listings, inaccurate data, or business losses resulting from reliance on AI-generated output or user-approved actions.
11. Service Availability
We aim to provide reliable access to the Service, but we do not guarantee uninterrupted, error-free, or always-available operation.
The Service may be unavailable due to maintenance, updates, technical issues, internet outages, hosting issues, third-party API changes, marketplace restrictions, or other factors beyond our control.
We may modify, suspend, replace, or discontinue features at any time.
12. Data Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information.
By using the Service, you agree to the data practices described in our Privacy Policy.
13. Suspension and Termination
We may suspend or terminate your account or access to the Service if:
- you violate these Terms;
- you misuse the Service;
- your payment fails;
- your activity creates risk for AutoScanner, users, third-party platforms, or service providers;
- we are required to do so by law or by a third-party platform requirement;
- continued access may harm the security or operation of the Service.
You may stop using the Service at any time.
You may request account deletion by contacting support@autoscanner.app.
14. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by applicable law, AutoScanner disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
AutoScanner does not warrant that the Service will meet your expectations, be error-free, produce accurate results, or remain compatible with any third-party platform.
15. Limitation of Liability
To the maximum extent permitted by applicable law, AutoScanner will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, marketplace account restrictions, listing removals, reputational harm, or loss of business opportunity.
To the maximum extent permitted by applicable law, AutoScanner’s total liability for any claim related to the Service will not exceed the amount you paid to AutoScanner for the Service during the three (3) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless AutoScanner, its owners, employees, contractors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:
- your use or misuse of the Service;
- your violation of these Terms;
- your violation of applicable law;
- your violation of third-party marketplace or platform policies;
- content or data you submit to the Service;
- actions you authorize through connected integrations.
17. Changes to the Terms
We may update these Terms from time to time.
If we make material changes, we may notify users by email, in-app notice, website notice, or another appropriate method.
Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be resolved by the competent courts located in Baku, Azerbaijan, unless otherwise required by applicable law.
